The arbitration shall be conducted pursuant to the rules of the American Arbitration Association which are in effect on the date a dispute is submitted to the American Arbitration Association. The hearing will take place in New Castle County, Delaware.
In no case shall the viewer, visitor, member, subscriber or customer have the right to go to court or have a jury trial. Viewer, visitor, member, subscriber or customer will not have the right to engage in pre-trial discovery except as provided in the rules; you will not have the right to participate as a representative or member of any class of claimants, pertaining to any claim subject to arbitration; the arbitrator's decision will be final and binding with limited rights of appeal.
The prevailing party shall be reimbursed by the other party for any and all costs associated with the dispute arbitration, including attorney fees, collection fees, investigation fees, and travel expenses.
This Agreement is governed by the laws of the State of Delaware. You hereby consent to the exclusive jurisdiction and venue of courts in Delaware, USA. in all disputes arising out of or relating to the use of this Site. Use of this Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation to this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and SAMURAI as a result of this agreement or use of this Site. The failure of SAMURAI to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. The Terms constitutes the entire agreement between you and SAMURAI and govern your use of the Site services, superseding any prior agreements between you and SAMURAI (including, but not limited to, any prior versions of the Terms).
If SAMURAI chooses not to enforce any of these provisions at any time, it does not mean that we give up that right later.
